SWEEPSTAKES VOID WHERE PROHIBITED

INTRODUCTION. These are the Official Rules of the “MY EASTON 1000” Sweepstakes (the “Sweepstakes”). Details of the prizes and how to enter the Sweepstakes are contained in these Official Rules.

TIMING. The Sweepstakes begins at 12:01 am Eastern Time on January 5, 2010 and ends at 11:59 pm Eastern Time on March, 1 2010 (the “Promotion Period”), or until 1000 entrants have been recieved. Whichever is the sooner.

TO ENTER. The Sweepstakes may only be entered online. You can enter the Sweepstakes online during the Promotion Period (as defined above), by logging on to http://eastonhockey.com/myeaston1000-sweepstakes and submitting an entry for the “My Easton 1000” sweepstakes. Submitting an entry requires that the user completes the registration form and populates a minimum of two (2) My Easton profile fields. Fields include About Me, Gear, Image/Video upload tool, add a profile image or post a comment. You may entry as many as you’d like during the entry period but are limited to (1) valid e-mail address per entry. You must be one of the first 1000 submissions that meet the above criteria to be included in the prize drawing. Any attempt by a person to enter more than once with the same email account or mailings may result in disqualification at the discretion of the Sponsor upon verification of prize winners. No other methods of entry will be accepted. Limit one entry per person regardless of method of entry.

USE OF DATA. Sponsor will be collecting personal data about participants (including, without limitation, name, phone number, mailing address and e-mail address) when they enter the Sweepstakes online. Sponsor is entitled to use such personal data contained in all entry forms in accordance with Sponsor’s Privacy Policy at www.eastonbellsports.com, in particular, to contact a potential winner regarding their prize and for future marketing announcements to participants from Sponsor via e-mail. By participating in the Sweepstakes, entrants hereby agree to all personal information uses and disclaimers as explained in Sponsor’s Privacy Policy. While this Sweepstakes is limited to participants 18 years of age or older, Sponsor believes that parents should supervise their children’s online activities and consider using parental control tools available from online services and software manufacturers that help provide a child-friendly online environment. These tools can also prevent children from disclosing online their name, address and other personal information without parental permission.

ADDITIONAL “USE OF DATA”-TERMS FOR PARTICIPANTS FROM MEMBER STATES OF THE EUROPEAN UNION. By entering the Sweepstakes personal data of the participants from Member States of the European Union are going to be transferred outside the European Union to the U.S.A. that has in general no equivalent laws and rules to protect personal data. Recipients of personal data of participants are: Easton Hockey and Easton-Bell Sports Inc. All personal data submitted as a part of this Sweepstakes will be treated in accordance with the European Union Data Protection Act and the Sponsor’s Privacy Policy at www.eastonbellsports.com . Sponsor will use personal information of participants only in connection with this Sweepstakes as provided in these Official Rules. Unless participants have given their prior express consent, Sponsor will not use, share or disclose personal data of participants with third parties in any manner, other than those necessary to fulfill the purpose of this Sweepstakes. Participants of the Sweepstakes have the right to access, withdraw and correct their personal data stored by the Sponsor. ELIGIBILITY. The Sweepstakes is open to all residents of the fifty United States and the District of Columbia (excluding Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions, and excluding where otherwise prohibited by law, rule or regulation) and residents of Canada, Austria, Czech Republic, Denmark, Finland, Germany, Hungary, Italy, France, Latvia, Slovak Republic and Sweden, who are 18 years of age or older at time of entry and who speak English. Void where prohibited by law. Special rules apply to residents of Canada and Quebec. Employees of Easton-Bell Sports, Inc. or its affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees’ families (defined as parents, children, siblings, spouse, and life partners).
AGREEMENT TO OFFICIAL RULES. Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and Sponsor’s Privacy Policy at http://www.eastonsports.com and to be contacted by telephone and/or email.

SELECTION OF POTENTIAL WINNER. Sponsor will choose one (1) Potential Winner for each Prize to be awarded on or about Friday, March 5, 2010. Each Potential Winner will be selected at 12:00 p.m. on Tuesday (March 2, 2010) or sooner depending upon receipt date of 1000 successful submissions in the Sponsor’s offices in Van Nuys, California at random from all of the eligible entries received. Each Potential Winner will be notified via telephone or email within ten (10) days of selection. Sponsor’s decisions as to all matters related to administration of the Sweepstakes and selection of each Potential Winner is final. Potential Winner must comply with all terms and conditions set forth in these Official Rules, and winning and award of Prizes is contingent upon fulfilling all requirements. If a Potential Winner cannot be contacted within SEVENTY-TWO (72) hours after the first attempt to contact such Potential Winner, then an alternate Potential Winner will be selected in his or her place. If an entry from a resident of Canada is selected as a Potential Winner, he/she must answer a time-limited mathematical skill-testing question in order to be declared a Winner and claim his or her Prize. The Prize will be delivered to each verified Winner via mail or delivery service.

PRIZES. There will be a total of five(5) Grand Prizes awarded in the Sweepstakes (each Grand Prize individually referred to as the “Grand Prize”, and may also be referred to as a “Prize” in these rules.) Each Grand Prize shall consist of one (1) Customized (name plate) Easton S19 Hockey Stick.. One (1) Grand Prize will be awarded to Five (5) of the first 1000 My Easton entries submitted.The Potential Grand Prize Winners will be selected on Tuesday, March 2, 2010 or sooner as outlined above. Odds of winning are 1 in 200 depending on the number of eligible entries received during the entire Promotion Period but not to exceed 1000 total entries. The approximate retail value of each Grand Prize is US$249.

Except where otherwise expressly noted in these Official Rules, the selection of all vendors, prizes, products and services is subject to the Sponsors’ sole and absolute discretion. Prizes (and/or any portion thereof) are nontransferable and non-exchangeable. No substitutions or cash redemption of prizes are permitted except that Sponsor retains the right to substitute a prize of equal or greater retail value (or at Sponsor’s election, the cash value of the applicable prize). Additional restrictions may apply.

All federal, state, provincial and local taxes related to each Prize are the sole responsibility of each Potential Winner. All other expenses and costs, not expressly listed above, including but not limited to any taxes, customs charges, and any other expense or cost, not expressly included above, are the Winner’s sole responsibility. No refunds or credit for changes are allowed. No transfer of the Prize is permitted. Each Potential Winner must execute and return an Affidavit of Eligibility/Release of Liability, Publicity and W9 within FIVE (5) days of notification. Noncompliance within this time period may result in disqualification, and an alternate winner may be selected. Return of any Prize notification as undeliverable may result in disqualification and selection of an alternate winner.

GENERAL CONDITIONS. Except where prohibited by law, the Sweepstakes is governed by the laws of the United States and Canada, and the State of California, excluding conflicts at laws principles. All federal, state, provincial and local laws and regulations apply. This Sweepstakes is void where prohibited. For participants from Member States of the European Union mandatory national law may apply in some cases that will substitute the laws of the United States and Canada, and the State of California.

Except as set forth in the paragraph immediately below, participants in the Sweepstakes hereby consent to the exclusive jurisdiction and venue of California courts (state and federal) in Los Angeles County for any causes or controversies arising out of the Sweepstakes. Each participant waives any and all objectives to jurisdiction and venue in these courts. This does not apply for participants from Member States of the European Union.

For Québec residents only – Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

Except where prohibited by law, each Winner grants to Sponsor and its advertising agencies the right to use and publish Winner’s photo, proper name, likeness, voice, opinions, biographical information and state in any media to promote Sponsor and the Sweepstakes without additional compensation. This does not apply for participants from Member States of the European Union. Together with the Affidavit named above Potential Winners from these countries will receive a document designed to obtain their free consent to use and publish Winner’s photo, proper name, likeness, voice, opinions, biographical information and state in any media to promote Sponsor and the Sweepstakes without additional compensation. The lack of consent does not prevent the Potential Winner from receiving the price.

By entering, participants release, and indemnify and hold harmless Easton-Bell Sports, Inc., Formula PR, and their respective subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind, including death, arising from or in connection with the Sweepstakes participant’s submission or receipt or use and/or misuse of any prize.

For Participants from Member States of the European Union the above shall not impair the liability of Easton-Bell Sports, Inc., Formula PR, and their respective subsidiaries, affiliates, directors, officers, employees and agents under mandatory applicable national laws which require the aforementioned to accept extended liability or responsibility. Neither shall the above apply for personal injuries or loss of life of participants from these countries which are attributable to culpable acts or omissions by the aforementioned.
Sponsor reserves the right at its sole discretion to cancel or modify the Sweepstakes if Sponsor determines that the Sweepstakes is impractical, fraudulent, void, unlawful, or if there are any technical or administrative malfunctions, errors, or other problems that affect the structure, terms or lawful administration of the Sweepstakes.

Online entries are deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The “authorized account holder” is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A Potential Winner may be requested to provide Sponsor with proof that the Potential Winner is the authorized account holder of the e-mail address associated with the winning entry or is a resident of the United States or the District of Columbia (excluding Rhode Island, Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions), or is a resident of Canada, Austria, Czech Republic, Denmark, Finland, Germany, Hungary, Italy, France, Latvia, Slovak Republic or Sweden. Prizes will only be awarded to the authorized account holders.
If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, the Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify or suspend the Sweepstakes, in whole or in part, at any time without notice. In the event of such cancellation, Sponsor reserves the right to award prizes in a random drawing from all eligible entries received before the time of cancellation.

Sponsor in no way promotes illegal acts, and any and all entries, which include or promote illegal acts will be disqualified.

Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, including http://www.eastonsports.com any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the Sweepstakes.

Should any provision of the Official Rules be or become invalid under the laws of a particular country this shall not affect the validity of the remaining provisions.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Results will be available after March 15, 2010. Requests for results must be received by April 15, 2009.
